Rob Hanratty, acting for Powell, of Llwyngwilym Barn, near Rhayader, argued that the case was suitable for summary trial, but prosecutor Justin Espie said the trial should be heard at the crown court.
Magistrates said that due to there being such a divide of opinion between the two parties that they were sending the case to the crown court for trial.
Powell is due to make a first appearance at Merthyr Tydfil Crown Court on October 25.
