A NEWTOWN man attacked another man in a club because of a previous incident in which he’d suffered a broken nose.

Previous bad blood between Jason Scott Mumby and Dominic Owen erupted when Mumby attacked Mr Owen in the Steam Mill nightclub in the early hours of Sunday, January 30. Mumby punched Mr Owen, who was carrying two pints at the time, sending him to the floor and leaving him with a gash on his head.

He needed hospital treatment, and a shard of glass was left embedded in his head for weeks after the attack.

Welshpool Magistrates’ Court heard this week that Mumby, 34, was left “shocked” by the amount of blood shown to him in photos of the incident by police.

Mumby, of Lower Canal Road, Newtown, had admitted causing actual bodily harm in May and appeared at Welshpool on Tuesday, August 9, for sentencing.

Prosecutor Helen Tench read a victim impact statement from Mr Owen, in which he said: “I have been left with a scar down my head and cuts above my eyebrow. It’s a bright red scar two inches long.

“I normally have short haircuts but I can’t anymore due to the wound. I was left with a lump that caused severe pain. I had to attend hospital and take time off work.

“Doctors had to open my head up again to find out what was causing the lump. It was a shard of glass, that was so deeply buried it was not detected originally.”

Rob Hanratty, acting for the defendant, said the case had required a Newton hearing because even though Mumby admitted the attack, he wanted to highlight the background to the assault, adding that the victim had given him a broken nose in 2021. He also claimed he sent him a "smirking" photo.

“On January 29 this year the defendant was out in town with an acquaintance, they were walking in Newtown," he said, adding that the victim of the assault had behaved in a way that had embarrassed her.

“Later in the evening the defendant was with a friend when he saw the victim walking in his direction. He anticipated there would be problems and he accepts he lashed out as soon as he came close to him.

“His head hit the ground, the injured party had been carrying two pints of beer, and he might have cut his head on a piece of glass. There was a scuffle and the defendant struck out again.

“He was not aware of any injuries and left the premises when requested. It was not prolonged or intended but it was precipitated by the injured party’s previous behaviour.

“Mr Mumby was shocked by the blood in the photos and is deeply remorseful. He is a well thought of young man and sportsman.”

Magistrates handed Mumby a 12-month community order, which will include completing 100 hours of unpaid work as well as 15 rehabilitation activity requirement days.

He was also ordered to pay £200 compensation to Mr Owen, plus a £95 surcharge and £85 costs.
