A man who headbutted his girlfriend on a bank holiday night out was given a community order.

Jake Jay Smith, 22, of Brynfa Avenue, Welshpool, was sentenced at Welshpool Magistrates’ Court on Tuesday after admitting the assault on Nichola Wain at an earlier hearing.

Rhian Jones, prosecuting, said Smith and Miss Wain got into an argument on the bridge near McDonald’s in Newtown after leaving Crystals nightclub at around 3.30am on May 1.

“Police received a call from a member of door staff at McDonald’s saying that Miss Wain had disclosed she had been assaulted by her boyfriend,” said Ms Jones.

They had been in a three-year relationship at the time, and had a young child together.

The argument began when Miss Wain said her feet were hurting and asked Smith if she could borrow his shoes, which he refused. He had then “got in her face” and “headbutted her using full force”.

Miss Wain was later found in the McDonald’s toilets with a bent and bloody nose by a manager who was also a friend of hers.

She spoke to police but did not want to give an account of the incident. Smith was arrested on Broad Street, and said he had drunk 12 Jagerbombs and several pints.

Ms Jones said: “He said he had lost his temper. He accepted he had headbutted her.

“Miss Wain provided a statement saying that she no longer supported the prosecution and wanted to continue the relationship.”

Smith was given a one-year community order with 20 rehabilitation activity requirement days and 100 hours’ unpaid work. He must also pay £85 costs and an £85 surcharge.
